OPTIMIZER TERMS OF SERVICE

1. ACCEPTANCE

By downloading, accessing, or using Optimizer, you agree to these Terms. If you do not agree, do not use the app.

2. THE SERVICE AND FREE TIER

Optimizer provides tools for scanning media, identifying possible duplicates, estimating storage use, creating smaller media copies, and optionally backing up exact originals to connected cloud storage. A free tier is available and may include limits or feature restrictions disclosed in the app.

3. OPTIONAL SUBSCRIPTIONS

Paid monthly or yearly subscriptions may be offered in the future. Any prices, billing periods, renewal terms, and included features will be displayed before purchase. This statement does not mean subscriptions are currently active.

Google Play manages subscription billing, cancellation, and applicable refunds under its own policies. You can manage eligible purchases through your Google Play account.

4. YOUR RESPONSIBILITIES AND PERMANENT ACTIONS

You must review selected files, backup status, storage estimates, and warnings before confirming an action. Compression and deletion can be irreversible. Files deleted without a backup may be permanently lost, and compressed media may not be recoverable at its original quality.

5. CLOUD SERVICES

You are responsible for maintaining access to your cloud account and sufficient available cloud storage. Third-party cloud services may be interrupted, changed, or unavailable. Cognito Labs LLC is not responsible for a cloud provider’s availability, account restrictions, or data-retention decisions.

6. ACCEPTABLE USE

You may use Optimizer only for lawful purposes and only with media and accounts that you are authorized to access. You may not misuse the service, interfere with its operation, attempt unauthorized access, or use it to violate another person’s rights.

7. INTELLECTUAL PROPERTY

Optimizer, its original interface, branding, code, and related materials are owned by Cognito Labs LLC or its licensors and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, non-exclusive, non-transferable right to use the app; they do not transfer ownership.

8. WARRANTY DISCLAIMER

To the extent permitted by law, Optimizer is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

9. LIMITATION OF LIABILITY

To the extent permitted by law, Cognito Labs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of media, data, access, profits, or goodwill arising from use of Optimizer. Any direct liability will be limited to the amount you paid for Optimizer during the twelve months before the claim. Nothing in these Terms limits liability that cannot legally be limited.

10. CHANGES

We may modify, suspend, or discontinue features and may update these Terms. Material updates will be presented through the app or this page as appropriate. Continued use after updated Terms take effect means you accept them.
